Terms of service

These Terms and Conditions govern the use of the Sunberry website and the purchase of products through the website. By accessing the website, placing an order, or using any of Sunberry’s services, the customer agrees to be bound by these Terms and Conditions.

1. Company Information

Sunberry Vegetables & Fruits is a UAE-based ecommerce business offering fresh fruits, vegetables, fresh-cut produce, ready-to-prepare ingredients, juices, beverages, platters, gifting items, boxes, and other related products.

2. Customer Obligations

The customer agrees to provide accurate, complete, and updated information when using the website or placing an order.

The customer shall be responsible for ensuring that all order details, delivery information, contact numbers, and payment details are correct before confirming the order.

The customer shall not misuse the website, submit false information, place fraudulent orders, or use the website or services for any unlawful purpose.

3. Product Information and Availability

Sunberry shall make reasonable efforts to ensure that product descriptions, images, prices, and availability are accurate. However, due to the natural and seasonal nature of fresh produce, products may vary in size, color, shape, ripeness, origin, appearance, and availability.

All products are subject to availability. In the event that a product is unavailable, Sunberry may offer a suitable replacement, alternative product, store credit, or refund.

4. Orders, Prices, and Payment

All prices are stated in UAE Dirhams unless otherwise specified. Prices may be amended at any time without prior notice due to market conditions, seasonality, supplier changes, promotions, or other business reasons.

An order shall be considered confirmed only after payment has been successfully completed and accepted by Sunberry.

Sunberry reserves the right to cancel, reject, or amend any order due to product unavailability, payment failure, incorrect pricing, suspected fraud, delivery restrictions, or any other reasonable cause.

5. Delivery

Sunberry shall deliver to selected areas within the UAE, including Dubai, Sharjah, Abu Dhabi, and other areas as may be made available on the website.

Delivery dates and times are estimates only and may be affected by location, product availability, order volume, weather, traffic, operational requirements, or circumstances beyond Sunberry’s control.

The customer shall be responsible for being available to receive the order at the confirmed delivery address and time slot.

If the customer is unreachable or unavailable at the time of delivery, Sunberry may cancel the order or arrange redelivery where possible. Additional delivery charges may apply.

Where the customer requests or authorizes the order to be left at a doorstep, reception, security desk, lobby, or any unattended location, the order shall be deemed delivered once placed at the requested location. Sunberry shall not be liable for any loss, theft, damage, spoilage, or deterioration occurring after delivery.

6. Product Handling After Delivery

Fresh fruits, vegetables, fresh cuts, juices, chilled products, and perishable items must be stored and handled properly immediately upon delivery.

The customer shall be responsible for the proper storage, refrigeration, and handling of all products after receipt.

Sunberry shall not be liable for any quality issue, spoilage, damage, or deterioration caused by improper storage, delayed collection, heat exposure, mishandling, or any act or omission of the customer after delivery.

7. Returns, Refunds, and Complaints

Due to the perishable nature of the products, returns shall not be accepted unless the product is damaged, spoiled, incorrect, or does not meet reasonable quality standards at the time of delivery.

Any complaint must be reported immediately after delivery by contacting Sunberry with the order number, clear photographs, and a description of the issue.

Sunberry shall review the complaint and may, at its discretion, offer a replacement, refund, store credit, or other appropriate resolution.

Sunberry shall not be obliged to accept complaints or returns for products that have been opened, consumed, improperly stored, mishandled, or reported after a reasonable period.

8. Cancellations

The customer may request cancellation before the order has been prepared or dispatched, subject to Sunberry’s approval.

Once an order or product has been dispatched, cancellation shall no longer be permitted, and Sunberry shall not be responsible for any cancellation request made after dispatch.

Where Sunberry accepts a cancellation after preparation has commenced but before dispatch, Sunberry may charge up to 50% of the total order value to cover preparation, handling, and product costs.

9. Promotions and Discounts

Promotions, discount codes, vouchers, and special offers shall be subject to availability, validity periods, and applicable terms.

Promotions and discounts are not redeemable for cash and may not be combined with other offers unless expressly stated.

Sunberry reserves the right to amend, suspend, or cancel any promotion, discount, voucher, or offer at any time.

10. Customized Orders and Gift Items

Fruit platters, cakes, gifting items, customized boxes, and special orders may require advance notice and are subject to product availability.

Final presentation, design, and product selection may vary depending on seasonality, stock availability, and preparation requirements.

Once preparation has commenced, customized or made-to-order products may not be cancelled, returned, or refunded unless there is a quality issue caused by Sunberry.

11. Allergies and Dietary Requirements

Certain products may contain or come into contact with allergens. While Sunberry takes reasonable care in handling products, Sunberry does not guarantee that any product is free from allergens or cross-contact.

Customers with allergies, dietary restrictions, or medical conditions shall be responsible for reviewing product information and contacting Sunberry before placing an order.

12. Intellectual Property and Privacy

All website content, including text, images, product descriptions, logos, graphics, designs, and other materials, is owned by or licensed to Sunberry and may not be copied, reproduced, distributed, or used without prior written consent.

Customer personal information shall be handled in accordance with Sunberry’s Privacy Policy.

13. Limitation of Liability

Sunberry shall make reasonable efforts to provide quality products and reliable service. However, Sunberry shall not be liable for delays, losses, damages, spoilage, or service interruptions caused by events beyond its reasonable control, incorrect customer information, improper product handling after delivery, technical errors, or natural variations in fresh produce.

To the extent permitted by applicable UAE law, Sunberry’s liability shall be limited to the value of the affected product or order.

14. Force Majeure

Sunberry shall not be liable for any failure or delay in performing its obligations where such failure or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government actions, road closures, supply shortages, system failures, strikes, accidents, or other unforeseen circumstances.

In such circumstances, Sunberry may delay, amend, suspend, or cancel the affected order or service without liability, provided that reasonable efforts are made to inform the customer where possible.

15. Amendments to Terms

Sunberry reserves the right to amend these Terms and Conditions at any time. Updated Terms shall be posted on the website with the revised effective date.

Continued use of the website or services following any amendment shall constitute acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.

Any dispute arising in connection with these Terms, the website, or any order shall be subject to the jurisdiction of the competent courts of the United Arab Emirates.
